Julie,

Thank you for your comments. I apologize for not mentioning the impact that this is also having on Eastern Shore Maryland. You are correct, all areas that are served by this ODAR are equally impacted.

I have noticed that we receive a disproportionate number of claims with the ALJs with the highest denial rates. It does not appear that the assignments have anything to do with the type of disability, but from discussions with other attorneys, it does appear that the ALJ with the highest approval rate hears mostly Kent and Sussex County claims.

Your feedback is greatly appreciated, and I will continue to feature articles dealing with these problems.

Two points to ponder...

1. It is not only Delaware residents who are suffering due to the Dover ODAR's decisions. Maryland's Eastern Shore has been hit hard. We have sent more claims to the Appeals Council in the last couple years than in the 10 years before that. Also, the AC is not remanding or reversing as many, so we have to go to District Court for many more claims. There are now very few attorneys on the Eastern Shore who will accept SSA claims.

2. It seems as though one particular ALJ, who has admitted she doesn't believe in mental disabilities, is hearing a disproportionate number of mental claims. Also, we have noticed that she seems to conduct far more hearings for our clients than the other ALJs do. Have you noticed anything like this?
