		<description>I would never want to discourage anyone from filing a complaint if they have been treated unfairly by an ALJ. My concern was that in the past it did not appear that the complaints were being handled in a professional manner. The Social Security Administration launched a new complaint tracking program this week to try alleviate these types of concerns. With the new system in place, the Social Security Administration will be able to better track which ALJs are generating the most complaints. I am hopeful that with this tracking, the Unfair Treatment Complaints will have more of an impact on resolving repeated problems.

My suggestion would be to talk about the Unfair Treatment Complaint with your attorney if you were represented. Normally I will ask that clients submit the complaint to my office first so that I can review and make suggestions on the content. If you are not currently represented, I would suggest consulting with an attorney for assistance with the appeal. Most likely, if the Appeals Council determines that a mistake was made in your original decision, you will have to have a new hearing in front of the same ALJ.
