Social Security

The majority of my practice involves claims for Social Security disability benefits, Social Security Disability Insurance and/or Supplemental Security Income. I assist individuals in Delaware, Maryland, New Jersey, and Pennsylvania with Social Security Disability claims.

There is no fee for the initial consultation for Social Security claims. I normally handle Social Security Disability cases on a contingency fee basis: I will not charge a fee unless I obtain benefits for you. If your claim is approved, I will generally charge a fee equal to 25% of the retroactive benefits you receive, but no more than $6,000.00, whichever amount is less.

Social Security has two disability programs:

  1. Social Security Disability Insurance (SSDI) also known as the Title II benefits; and
  2. Supplemental Security Income (SSI) also known as Title XVI benefits.

Both of the programs have the same medical requirements. The primary difference between SSDI and SSI benefits is the non-medical requirements. This is because SSDI is limited to claimants who have worked approximately 5 out of the last 10 years. Social Security divides each year into 4 quarters and requires that a claimant show that he or she was employed and paid Social Security taxes for 20 of the last 40 quarters (5 out of the last 10 years). If someone is under 28 years of age, adjustments are made for the quarters needed.
